1. Introduction & Acceptance

Welcome to Track My Copper (“App”). These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you”, “User”) and Track My Copper LTD (“Company”, “we”, “us”, “our”). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App. Where mandatory local consumer, health, or data protection laws grant you additional rights, those rights apply despite anything stated in these Terms.

2. Purpose of the App

Track My Copper is a self-management and informational tool designed to support individuals living with Wilson’s Disease. Features may include symptom tracking, copper intake logging, medication tracking, journaling, and wellness insights.

3. User Accounts & Security

You are responsible for:

  • All activity carried out under your account
  • Promptly notifying us of any unauthorized access or security concerns

We may suspend or terminate accounts that violate these Terms.

3.1 Data Security & Breach Notification

We use reasonable technical and organizational measures to protect personal data. However, no system is completely secure. If a data breach occurs, affected users and relevant authorities will be notified within legally required timeframes (for example, within 72 hours under UK GDPR).

3.2 Age Requirements & Parental Consent

  • Users must be 18 years or older to use the App independently
  • Users under 18 may use the App only with parental or guardian consent
  • Parents or guardians may request access to or deletion of their child’s personal data

4. Medical & Emergency Disclaimer

  • No doctor–patient or healthcare relationship is created
  • All content is provided for informational and self-management purposes only
  • You are solely responsible for decisions made using the App

Emergency Situations

  • The App is not intended for emergencies
  • Do not rely on the App in urgent or life-threatening situations
  • Contact emergency services immediately (e.g. 999, 911, or local equivalent)

5. Dietary Copper Information

  • Copper intake values are provided for reference only
  • Values are derived from publicly available databases (UK, US, AU)
  • Actual copper content may vary based on sourcing, preparation, or processing
  • Always consult healthcare professionals before making dietary or medication changes

6. User Responsibility for Data Entry

  • You are solely responsible for the accuracy and completeness of information you enter
  • You are solely responsible for making healthcare decisions in consultation with qualified professionals

We are not responsible for errors, omissions, or outcomes resulting from user-provided data.

7. Limitation of Liability & No Warranties

The App is provided “as is” and “as available.” To the maximum extent permitted by law, Track My Copper LTD is not liable for:

  • Health outcomes resulting from App use
  • Reliance on App data or content
  • Data inaccuracies or user-entered errors
  • Indirect, incidental, or consequential damages

Where liability cannot be excluded, it is limited to the minimum extent required by law.

8. Critical Use Disclaimer

  • It is not an emergency or critical care service
  • Access to data or features may be delayed or unavailable
  • You will seek professional or emergency assistance when required

9. Data Protection & Privacy

We process personal and health data in accordance with UK GDPR, Data Protection Act 2018, GDPR, HIPPA, and other applicable laws, and our Privacy Policy. Track My Copper LTD is registered with the UK Information Commissioner’s Office (ICO) as a data controller.

10. Free Trial & Subscriptions

Free Trial

  • A free trial may be offered to new users
  • Limited to one free trial per user
  • Apple or Google may require a valid payment method
  • No charges occur during the free trial period

Paid Subscriptions

  • Premium features require an active subscription
  • Pricing, billing frequency, and features are shown before purchase
  • Subscriptions renew only after user confirmation
  • Refunds and billing disputes are governed by Apple or Google policies, unless required by law

Changes: Where permitted by law, we may modify features or subscription plans, change pricing or tiers with advance notice where required. Nothing in this section limits your statutory consumer rights.

11. Community Conduct & Acceptable Use

If the App includes community, messaging, or social features, you agree to use them respectfully and lawfully.

You must not:

  • Harass, bully, threaten, or abuse others
  • Engage in hate speech, discrimination, or sexually explicit content
  • Share false or harmful medical information
  • Provide medical advice, diagnosis, or treatment
  • Impersonate others or misrepresent your identity
  • Post spam, illegal content, or private information
  • Upload unlawful, defamatory, obscene, or inappropriate content
  • Interfere with the App’s security or functionality

You are solely responsible for content you submit or share.

11.1 Moderation & Enforcement

  • We may, at our discretion and without prior notice: monitor or remove user-generated content
  • Suspend or terminate accounts
  • Restrict access to community features
  • Report illegal activity to authorities where required

11.2 No Responsibility for User Content

We do not endorse or verify user-generated content and are not responsible for interactions between users, except where required by law.

12. Termination

We may suspend or terminate access for misuse or violations of these Terms. Provisions relating to liability, intellectual property, payments, and governing law survive termination.

  • Unauthorized copying, distribution, or modification is prohibited.
  • All rights are reserved by Track My Copper LTD.

14. No Affiliation or Endorsement

The App is not affiliated with or endorsed by any healthcare provider or regulatory authority and has not been evaluated by the FDA, MHRA, or similar bodies.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Unless required otherwise by local law, disputes fall under the exclusive jurisdiction of the courts of England and Wales. Mandatory consumer protections in your jurisdiction remain unaffected.

We may update these Terms from time to time. Continued use of the App means you accept the updated version.
